CONSENT ITEMS
10.1 MOTION - CONTRACT EXTENSION - DOCUMENT REPRODUCTION SERVICES
This motion, recommended by the Finance Department, extends Contract No. 08-8929 for document reproduction services with Green Tara, Inc., dba Clone Digital Print and Copy, Santa Rosa, CA, for an additional one-year term, with a .01% increase in contract unit prices for three paper items. The total amount of contract extension is $125,000. Funds for this operational expense have been allocated in the budgets of various departments.
10.2 RESOLUTION - ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 4065 MADERA AVENUE
This resolution, recommended by the Department of Community Development, confirms the special assessment lien in the amount of $19,376.75 against the real property located at 4065 Madera Avenue for violations of the City Code that remain uncorrected by the responsible parties, Jose R. Cuevas and Thamar Cuevas, and authorizes recording of a lien and placing the assessment on the property tax roll for collection.
10.3 RESOLUTION - AMENDMENT OF BUDGET DEFICIT REDUCTION MEASURE DATED 5-4-10
This resolution, recommended by the Information Technology Department, directs staff to eliminate (1.0) FTE IT position and amend Resolution #27650 to retain a (1.0) FTE IT Section Manager and increase (2.0) .75 FTE Programmer Analysts to (2.0) 1.0 FTE through salary savings associated with eliminating the (1.0) FTE IT position.
10.4 ORDINANCE ADOPTION - ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA AMENDING TITLE 20 OF THE SANTA ROSA CITY CODE – SECTIONS 20-22.030, 20-23.030, 20-36.040, 20-42.190 AND 20-70.020 – FILE NUMBER ST10-003
This ordinance, introduced at the January 11, 2011, Regular Meeting, amends Zoning Code Sections 20-22.030, 20-23.030, 20-36.040 and 20-70.020, and add Zoning Code Section 20-42.190 consistent with the Housing Element of the Santa Rosa General Plan 2035.

11 REPORT - SENATE BILL 375 AND THE SUSTAINABLE COMMUNITIES STRATEGY
BACKGROUND: Senate Bill 375 was passed in 2008 and is considered landmark legislation in California relative to land use and transportation planning. The measure requires development of regional targets for greenhouse gas emissions reduction, requires regional planning agencies to develop a Sustainable Communities Strategy to meet the targets, and links regional planning for transportation and housing. The purpose of this item is to brief the council on activities related to Senate Bill 375 and the development of the Sustainable Communities Strategy for the Bay Area.
RECOMMENDATION: It is recommended by the Department of Community Development that the Council receive a report regarding Senate Bill 375 and the Sustainable Communities Strategy.

12 PUBLIC HEARING – FY 2011/12 BUDGET PRIORITIES
BACKGROUND: The City Charter, Section 28(a), provides that the City Council hold a public hearing each year for the purpose of soliciting oral and written comments on budget priorities for the next fiscal year. This hearing has been noticed and scheduled in order to receive the public's input and to comply with the requirements of the Charter. The budget year to be addressed in this hearing is the 2011/12 fiscal year.
RECOMMENDATION: The City Council should consider written and oral comments presented at the public hearing for future budget deliberations. No action is necessary.

13 PUBLIC HEARING – ADOPTION OF NEGATIVE DECLARATION AND APPROVAL STREET FURNISHINGS PALETTE PLAN AND AMENDMENTS TO ZONING CODE REGARDING SIDEWALK CAFES
BACKGROUND: In October 2007 the Council adopted the Downtown Station Area Specific Plan (Specific Plan). One of the priority implementation steps called for by the Specific Plan is the development of Street Furniture Palettes. The Palettes will provide guidance for street furniture purchases in association with new development and capital improvement projects, and for purchases made by both the public and private sectors. The project also includes minor changes to the Sidewalk Café section of the Zoning Code, and the addition of a new “Street Furnishings Palette” sub-section within the Core Area section of the Design Guidelines. On November 17, 2010, the Planning Commission adopted resolutions (5-0-1-1) recommending that the Council adopt the Street Furnishings Palette Plan, Zoning Code Amendments and Negative Declaration. On December 16, 2010, the Design Review Board adopted resolutions (5-0-0-2) recommending that the Council adopt the Street Furnishings Palette Plan, Design Guidelines Amendments and Negative Declaration. On January 5, 2011, the Cultural Heritage Board adopted resolutions (6-0-0-1) recommending that the Council adopt the Street Furnishings Palette Plan and Negative Declaration.
RECOMMENDATION: It is recommended by the Department of Economic Development and Housing that the Council, by resolution, adopt the Negative Declaration for the Street Furnishings Palette Project for the Courthouse Square and Railroad Square sub-areas of the Downtown Station Area Specific Plan, File No. SRC-X-20 and the Street Furnishings Palette Plan. It is further recommended that the Council adopt an amendment to the Design Guidelines Section 2, Core Area, to add a new subsection 2.6, Street Furnishings Palette. It is further recommended that the Council introduce an ordinance amending Zoning Code Section 20-42.160, Sidewalk Cafés, for the Courthouse Square and Railroad Square Sub-Areas of the Downtown Station Area Specific Plan.

14 PUBLIC HEARING - GOODWILL SECOND HAND RETAIL STORE APPEAL
BACKGROUND: On November 17, 2010, the Planning Commission adopted a resolution (4-0-3) approving a Minor Conditional Use Permit to allow a 5,370 square foot second hand retail store at 1300 Fourth Street. On November 29, 2010, Thomas and Patrice Giansante and others filed an appeal of the Planning Commission's decision.
RECOMMENDATION: It is recommended by the Planning Commission and the Community Development Department that the City Council hold a public hearing and deny the appeal, and adopt a resolution approving a Minor Conditional Use Permit for the Goodwill Second Hand Retail Store located at 1300 Fourth Street.
