3. STUDY SESSION 

3.1 2  UPDATE ON THE SAFE ROUTES TO SCHOOL PROGRAM AND RESOURCES IN SANTA ROSA

Staff will present an update on the City’s 2-year pilot Safe Routes to School Program which was in partnership with the City of Santa Rosa School district.  The City’s Safe Routes to Schools Program will conclude this calendar year.  The presentation will include an update on efforts to continue the Safe Routes to Schools Program on a countywide level. 

3.2 3  NORTH COAST RAILROAD AUTHORITY SERVICE (NCRA) UPDATE

The purpose of this study session is to update Council on the North Coast Railroad Authority's (NCRA) freight rail service startup within Sonoma County. Staff will briefly review the service and safety outreach plans and discuss economic opportunities provided by the new service.

10. 10  CONSENT ITEMS

10.1 MOTION - CONTRACT EXTENSION - EMPLOYEE BENEFITS CONSULTANT/BROKER SERVICES 

This motion, recommended by the Finance and Human Resources Departments, approves Amendment No. 3 to extend for a two-year period contract number 06-8355 for employee benefits consultant/broker services with Alliant Insurance Services, Inc., San Francisco, California, in the total amount not to exceed $168,000 in commissions.

10.2 RESOLUTION - AMENDMENT TO THE CITY CLASSIFICATION AND SALARY PLAN TO RECLASSIFY TWO VACANT SENIOR ADMINISTRATIVE ASSISTANT POSITIONS TO ADMINISTRATIVE TECHNICIAN POSITIONS IN ENGINEERING SERVICES, PUBLIC WORKS DEPARTMENT

This resolution, recommended by the Human Resources Department, amends the City’s Classification and Salary Plan by reclassifying two (2) vacant Senior Administrative Assistant positions in Org. 100406 to Administrative Technician positions in Org. 100402 and Org. 100407.  This action is expected to result in cost savings for CIP projects and will have no financial impact to the General Fund.

10.3 RESOLUTION - BENEFIT FINDINGS AND REDEVELOPMENT AGENCY BUDGET REVISIONS FOR THE BURBANK AVENUE PATHWAY – SOUTHWEST PROJECT AREA 

This resolution, recommended by the Department of Economic Development and Housing, makes certain benefit findings and approves budget revisions to the FY 2010/11 Redevelopment Agency budget for the Burbank Avenue Pathway from Hearn Avenue to Roseland Creek Elementary School.

10.4 RESOLUTION - ADOPTION OF RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA AMENDING COUNCIL POLICY 000-55, CONTINGENCY RESERVE OF THE INFORMATION TECHNOLOGY INTERNAL SERVICE FUND  

This resolution, recommended by the Information Technology Department, amends Council Policy 000-55, originally adopted in June 2006, pertaining to the Information Technology Internal Service Fund contingency reserve, to reflect a reduction in appropriate reserve level based on recent changes in technology and associated replacement costs.

10.5 RESOLUTION - REVISED MEMORANDUM OF MUTUAL UNDERSTANDINGS FOR AN INTEGRATED REGIONAL WATER MANAGEMENT PLAN 

This resolution, recommended by the Board of Public Utilities and the Utilities Department, authorizes the Mayor to execute the revised Memorandum of Mutual Understandings Integrated Regional Water Management Plan (November 11, 2010).

11. REPORT ITEMS

11.1 11  REPORT - SONOMA COUNTY WATER AGENCY 2011/12 WATER TRANSMISSION BUDGET AND WATER RATE INCREASE 

BACKGROUND: Sonoma County Water Agency (SCWA) staff presented the 2011/12 Water Transmission System budget to the Council in a staff presentation on February 1, 2011.  At this presentation, SCWA indicated that SCWA staff will be requesting a 5% increase in the SCWA wholesale cost of water.

The WAC is an advisory committee to the SCWA Board of Directors. The City’s WAC Representative is Councilmember Susan Gorin.  On February 7, 2011 the WAC heard a presentation on and discussed the SCWA budget and then on March 7, 2011 the WAC is scheduled to vote on whether or not to recommend the SCWA budget for approval to the SCWA Board of Directors. 

RECOMMENDATION: It is recommended by the Board of Public Utilities that the Council, by motion, authorize Santa Rosa's WAC representative to vote in favor of approving the proposed 2011/12 SCWA water transmission budget and water rate increase request.

11.2 12  REPORT - KELLY FARM RECREATIONAL TRAIL EASEMENT

BACKGROUND: On March 6, 2001, the Sonoma County Agricultural Preservation and Open Space District approved the conveyance of an utility easement to the City of Santa Rosa for a portion of the Geysers Recharge Pipeline on Pine Flat Road conditioned, in part, upon the City’s conveyance of an Irrevocable Offer of Dedication of a public recreational trail easement across the Stone, Kelly, Alpha and Brown Farms owned by the City within the Laguna de Santa Rosa.  An Irrevocable Offer of Dedication was granted by City to County in Instrument Number 2002020322, recorded on February 8, 2002.

The District, in consultation with the County, prepared the Laguna de Santa Rosa Protected Lands Trails Plan (Project), and has reviewed the Project pursuant to the California Environmental Quality Act (CEQA) in the Laguna de Santa Rosa Protected Lands Trails Plan Mitigated Negative Declaration and Initial Study, dated August, 2006 and has included a number of mitigation measures in the Mitigated Negative Declaration to avoid potentially significant environmental impacts of the Project. The City has reviewed and considered the information contained in the Mitigated Negative Declaration and finds that changes or alterations have been required in, or incorporated into, the Project which avoid any potentially significant environmental effects as identified in the Mitigated Negative Declaration.

The County wishes to obtain and the City wishes to grant a public recreational trail easement over a portion of Kelly Farm in accordance with the terms and conditions in the Kelly Farm Easement Agreement.  The Sonoma County Water Agency (Agency) has an ownership interest in a parcel adjoining Kelly Farm and has requested the City’s written consent to allow County use of the Agency’s property for public trail easement purposes.  As a condition of the Kelly Farm Easement Agreement, the County will execute a Quitclaim of a Portion of its Easement Rights granted to it by City in the Irrevocable Offer of Dedication.

RECOMMENDATION: It is recommended by the Utilities Department that the Council, by resolution: 

• make findings pursuant to CEQA Open Space District's Mitigated Negative Declaration, 
• approve the Kelly Farm Easement Agreement, 
• consent to the Quitclaim of the County of a portion of its easement rights,
• approve the Consent Agreement with the Agency; and
• authorize the Mayor to sign the Agreements and Consent to Quitclaim.

11.3 13  PUBLIC HEARING – REQUEST FROM PETALUMA ECUMENICAL PROPERTIES TO AUTHORIZE ISSUANCE, SALE AND DELIVERY OF TAX-EXEMPT MULTIFAMILY HOUSING REVENUE BONDS FOR ACACIA LANE SENIOR APARTMENTS (657 ACACIA LANE) IN A PRINCIPAL AMOUNT NOT TO EXCEED $8,600,000

BACKGROUND:  Petaluma Ecumenical Properties (PEP Housing) has requested that the Council authorize issuance, sale and delivery of tax-exempt multifamily housing revenue bonds to assist the financing of the construction and development of Acacia Lane Senior Apartments, a 44-unit affordable rental housing development located at 657 Acacia Lane (formerly addressed as 4711 Sonoma Highway) in northeast Santa Rosa (the Project).  Pursuant to the U.S. Internal Revenue Code, the Council held a Tax Equity Fiscal Responsibility Act (TEFRA) public hearing on November 3, 2009 and passed a Resolution declaring its intent to issue tax-exempt bonds for the Project and authorizing an application to the California Debt Limit Allocation Committee (CDLAC) for an allocation of Private Activity Bonds.  On January 26, 2011, CDLAC approved a bond allocation of $8,600,000 for the Project.  Because the original TEFRA public hearing was held more than one year ago, the U.S. Tax Code requires another TEFRA public hearing prior to the approval of the bond issuance.  The bond financing is structured so that the City has no financial liability to the bondholders. The Project owner is responsible for payment of all costs of bond issuance.

RECOMMENDATION:  It is recommended by the Department of Economic Development and Housing that the Council, following the public hearing, by resolution, authorize the issuance, sale and delivery of tax-exempt multifamily housing revenue bonds in a principal amount not to exceed $8,600,000 to assist in the financing of the construction and development of Acacia Lane Senior Apartments, an affordable rental housing development located at 657 Acacia Lane, and approve execution of the appropriate documents for the Bonds by the authorized City officials.

11.4 14  PUBLIC HEARING - ABANDONMENT OF SIX PUBLIC UTILITY EASEMENTS ON COUNTY PROPERTY

BACKGROUND: Public Utility Easements were recorded over properties in the County of Sonoma administration complex to allow City access to the utility infrastructure provided to the County complex by the City of Santa Rosa in order to allow maintenance activities. Infrastructure and utility services have since been redesigned and relocated and these easements are no longer necessary to provide maintenance access by City staff.

RECOMMENDATION: It is recommended by the Community Development Department that Council, by resolution, abandon the six Public Utility Easements identified on multiple parcels within the Sonoma County administration complex, turning over the infrastructure ownership and maintenance requirements to the County of Sonoma.
