CONSENT ITEMS
10.1 MOTION -- CONTRACT AWARD – POLICE SEDANS
This motion, recommended by the Finance and Police Departments, authorizes the contract award and issuance of a purchase order for four Ford Crown Victoria police sedans with extended power train warranties to the lowest responsive and responsible bidder, Hansel Ford, Santa Rosa, California, in the total amount of $102,538.40. Funding for this capital purchase is allocated in the Police Department project account numbers 4459, Replacement Fund Police Vehicle Purchases ($76,903.80) and 4204, JAG Formula Grant 2009 Programs 2 ($25,634.60), object code 584.
10.2 RESOLUTION -- CONTRACT AWARD – 2010 FORD F550 4-DOOR 4X4
This resolution, recommended by the Finance, Fire and Public Works Departments, authorizes the contract award and issuance of a purchase order for one 2010 Ford F550 4-Door 4X4 Type IV Emergency Vehicle to the lowest responsive and responsible bidder, Placer Fire Equipment, Mather, CA, in the amount of $176,797.09, and increases appropriations in 3016-84 Equipment Replacement Purchases by $176,797.09, with the source of funds being the reserves of the Equipment Replacement Fund.
10.3 RESOLUTION -- APPROPRIATING FUNDS FOR REMODEL OF THE POLICE DEPARTMENT COMMUNICATIONS CENTER
This resolution, recommended by the Police Department, appropriates funds in the amount of $186,000, for the remodel of the Police Department Communications Center. The source of the funds is the State of California 911 Fund.
11. REPORT ITEMS
11.1
8 REPORT -- TRANSIT MALL RELOCATION AND DETOUR PLAN
BACKGROUND: The Transit Mall Revitalization project began principal design in the summer of 2008, with an approved expanded design program in spring 2009. The project requires closing the Transit Mall during construction, projected to take place during summer of 2010, and relocating the transit hub services to an alternate location. The Transit Department seeks Council review and approval of the proposed relocation site.
RECOMMENDATION: It is recommended by the Transit Department that the Council, by motion, relocate the Transit Mall to Sonoma Avenue between D Street and Santa Rosa Avenue during construction of the Transit Mall Revitalization Project, and allow closure of that portion of the street to all traffic except Public Transit and Emergency Services vehicles.
11.2
9 REPORT -- TRANSIT MALL PUBLIC ARTIST SELECTION
BACKGROUND: The Transit Mall Revitalization Project includes the installation of Public Artwork as a primary component of the project. Between July 2009 and January 2010, the Transit Department solicited artist qualifications through a public process that received 115 submittals, which were narrowed through a three-step review process by the Transit Mall Artwork Selection Committee. The Transit Mall Artwork Selection Committee now recommends selecting Leticia Huerta of Arlington, Texas as the principal artist.
RECOMMENDATION: It is recommended by the Transit Department and Transit Mall Public Art Selection Committee that the Council, by motion, select artist Leticia Huerta as the principal artist for the Transit Mall Revitalization Project and authorize the Transit Director to enter into an Artwork Commission Agreement with Ms. Huerta following review by the City Attorney.

10 REPORT -- REVISION TO CHAPTER 11-08 OF THE CITY CODE RELATING TO STAFF DELEGATIONS OF CITY TRAFFIC ENGINEER AND CITY PARKING MANAGER FUNCTIONS
BACKGROUND: The delegation of duties set forth in Chapter 11-08 of the City Code has become outdated due to recent staffing and organizational changes. Staff will present a revision of the chapter in the form of an ordinance that makes changes to the delegated authorities for the City Traffic Engineer and allows the City Manager to assign the City Traffic Engineer function to an appropriate staff member. In addition, the ordinance establishes a City Parking Manager function to be assigned by the Director of Economic Development and Housing to manage the city’s urban parking activities.
RECOMMENDATION: It is recommended by the Department of Public Works that the Council, by ordinance, revise and restate Chapter 11-08 of the City Code relating to staff delegations for Traffic Engineer and City Parking Manager functions.
11.4
11 REPORT -- GREENHOUSE GAS WORK GROUP UPDATE
BACKGROUND: Greenhouse gases (GHGs) are gases present in the earth’s atmosphere and are essential to maintaining the temperature of the earth. Their sharp increase is the main cause of climate change. The Community Development Department established a Greenhouse Gas (GHG) Work Group in September 2008 which is tasked with developing expertise on GHG issues, developing a strategy to address current GHG reduction mandates and long term Citywide GHG reduction strategies. The members of the group include staff representatives from the departments of Utilities, Transit, Parking, Advance Planning, Public Works and Community Development. The GHG Work Group has an update regarding the City of Santa Rosa’s progress related to the Sonoma County Community Climate Action Plan and GHG emission reduction.
RECOMMENDATION: No action is requested at this time.

12 REPORT -- ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA REPEALING EXISTING SANTA ROSA CITY CODE CHAPTER 6-32, MASSAGE ESTABLISHMENTS, AND ENACTING NEW CHAPTER 6-32, MASSAGE THERAPY, MASSAGE BUSINESS OR ESTABLISHMENT
BACKGROUND: The Santa Rosa Police Department is mandated by the existing Santa Rosa City Chapter 6-32, Massage Establishments (massage ordinance), to issue permits to any person, massage business or massage establishment, who is performing or engaging in the practice of massage within the City. On September 27, 2008, the State of California enacted SB 731 Massage Therapy Title Act. This law commenced September 1, 2009, providing for a voluntary statewide certification of massage practitioners and massage therapists by the Massage Therapy Organization (MTO). A key section of SB 731 prohibits the City from enacting and/or enforcing certain ordinances regulating the practice of massage by a certificate holder, which is currently in conflict with existing Santa Rosa City Code Chapter 6-32, Massage Establishments. To be in compliance with new State law, it is necessary to enact a new City Code Chapter 6-32, Massage Therapy, Massage Business or Establishment (massage ordinance).
RECOMMENDATION: It is recommended by the Police Department and the City Attorney's Office that the Council, by ordinance, repeal existing Santa Rosa City Code Chapter 6-32, Massage Establishments, and adopt and enact a new Chapter 6-32, Massage Therapy, Massage Business or Establishment, to be in compliance with SB 731, Massage Therapy Title Act, chartered into California law on September 27, 2008.

13 PUBLIC HEARING -- WEED AND RUBBISH ABATEMENT PROGRAM
BACKGROUND: The procedure for implementing the Weed and Rubbish Abatement Program is for the Council to declare, by resolution, weeds and rubbish as a public nuisance. This was done February 2, 2010. The second procedure is to publish a notice of a public hearing, at which time a person or persons may voice an objection to the Weed and Rubbish Abatement Program. After hearing any or all protests, the Council then, by resolution, grants or overrules any such protests that weeds or rubbish within the City are a public nuisance and authorizes the Fire Department to abate the nuisances.
RECOMMENDATION: It is recommended by the Fire Department that the Council, by resolution, overrule any protests and authorize the Fire Department to abate the nuisances.
