3. 1 JOINT STUDY SESSION OF CITY COUNCIL/PLANNING COMMISSION

3.1 2 ANNUAL REVIEW OF THE GENERAL PLAN AND GROWTH MANAGEMENT AND HOUSING ALLOCATION PLAN ORDINANCES

Each year, the Planning Commission and City Council review the General Plan, consistent with state planning and zoning law. The study session will allow time to cover General Plan actions in 2010, housing needs information, as well as to review the operation of the Growth Management program and the Housing Allocation Plan over the last year.

PUBLIC COMMENTS: Comments from the public will be allowed at this time only on the subject of the Special Meeting.

10. 11 CONSENT ITEMS

10.1MOTION - CONTRACT AWARD - COBRAHEAD INDUCTION STREETLIGHTS

This motion, recommended by the Finance and Public Works Departments, authorizes the contract award and issuance of a purchase order for six hundred (600) Cobrahead Induction Streetlights to the lowest responsive and responsible bidder, JAM Services, Livermore, California, in the total amount of $158,794.88. Funding for this purchase is allocated in the Public Works Department JL Key Number: 001410-5341/17425-00, Street Light Efficiency Project 09ARRA Purchase.

10.2RESOLUTION - TRANSPORTATION DEVELOPMENT ACT (TDA) ARTICLE III GRANT APPLICATION FOR FISCAL YEAR 2011/2012

This resolution, recommended by the Transit Department, approves the request to the Metropolitan Transportation Commission (MTC) for Transportation Development Act Article III funds for the Humboldt Street Bike Boulevard Traffic Calming project, Pedestrian Flasher on Hearn Avenue and Old Stony Point Road, and the rehabilitation of the Brush Creek Class I path, and authorizes the Director of the Transit Department to file the application and other required documents for requesting and executing the allocation of funds.

10.3RESOLUTION - ACCEPTANCE OF PROPOSITION 1B FUNDS FROM CALIFORNIA TRANSIT SECURITY GRANT PROGRAM - CALIFORNIA TRANSIT ASSISTANCE FUND

This resolution, recommended by the Transit Department, 1) authorizes the submittal of an application to the California Emergency Management Agency (CalEMA) requesting $25,113 from the California Transit Security Grant Program-California Transit Assistance Fund (CTSGP-CTAF) to purchase and install safety and security enhancements at transit centers in Santa Rosa, and 2) appoints the Transit Director as the authorized agent to execute any actions necessary for this application, the acceptance of these funds, compliance with this grant program, and the completion of the project.

10.4RESOLUTION - ANNUAL REVIEW OF THE GENERAL PLAN AND THE GROWTH MANAGEMENT AND HOUSING ALLOCATION PLAN ORDINANCES

This resolution, recommended by the Community Development Department, authorizes the City Council to receive a report regarding the Annual Review of the General Plan and the Growth Management and Housing Allocation Plan Ordinances.

10.5RESOLUTION - PROFESSIONAL SERVICES AGREEMENT - NORTH SANTA ROSA STATION AREA SPECIFIC PLAN

This resolution, recommended by the Department of Community Development, authorizes the mayor to sign the Agreement for Professional Services with Pacific Municipal Consultants (PMC) for preparation of the North Santa Rosa Station Area Specific Plan and Environmental Impact Report.

10.6RESOLUTION - ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 592 CHERRYWOOD DR

This resolution, recommended by the Department of Community Development, confirms the special assessment lien in the amount of $23,782.58 against the property located at 592 Cherrywood Drive for violations of the City Code that remain uncorrected by the responsible party, Alvaro Vidrio Contreras, and authorizes recording of a lien and placing the assessment on the property tax roll for collection.

11. REPORT ITEMS

11.1 12 REPORT - COUNCIL DIRECTION TO CITY ATTORNEY REGARDING CHARTER REVIEW

BACKGROUND: Section 12 of the City Charter provides that the Charter is to be reviewed in 2002 and then every ten years thereafter. Under Section 12, the next review of the City Charter should be completed no later than 2012. In order for any potential amendments to the Charter to be placed on the November 2012 ballot, the Council would need to take action on the proposed measures no later than August 2012. City Council elections will also be on the ballot in November 2012.

The Council could also elect to review the Charter at an earlier date to be able to place any changes on a ballot prior to November 6, 2012. Possible dates would be November 8, 2011, March 6, 2012 or June 5, 2012 when other County elections would be scheduled.

RECOMMENDATION: It is recommended by the City Attorney, that the Council, by motion, provide direction to the City Attorney regarding the timing of when it would like to commence the charter review and target date for election on possible amendments to the Charter.

The City Attorney further recommends that the Council, by motion, provide direction to the City Attorney to proceed as outlined in the staff report to commence the Charter Review Process or provide direction as to any desired changes to the proposed process.

**11.2 13 PUBLIC HEARING - ELNOKA VILLAGE ENVIRONMENTAL IMPACT REPORT CERTIFICATION APPEAL

BACKGROUND: On January 13, 2011, the Planning Commission adopted a resolution (5-2)certifying the Elnoka Village Final Environmental Impact Report. On January 21, 2011, the Oakmont Village Association filed an appeal of the Planning Commission's decision.

RECOMMENDATION: It is recommended by the Planning Commission and the Community Development Department that the City Council hold a public hearing and deny the appeal, and adopt a resolution certifying the Elnoka Village Final Environmental Impact Report.
