CONSENT ITEMS
10.1RESOLUTION - CONTRACT AWARD - MAINTENANCE AND REPAIR OF HVAC EQUIPMENT
This resolution, recommended by the Finance and the Recreation, Parks, and Community Services Departments, awards a competitively bid contract for the maintenance and repair of heating, ventilating and air conditioning (HVAC) equipment at City Hall, City Hall Annex, the Finley Community Center, Municipal Services Center South, and most other City facilities with Troxel HVAC , Cotati, CA, for two years, with three one-year extension options. The contract offers a labor rate that it 5% less than what the City currently pays Troxel HVAC for their services. The total amount of the two year contract is $214,498. Funding for this expense is allocated in the FY 2010-2011 operational budgets of various departments that utilize these services.
This resolution, recommended by the Public Works Department, authorizes the Director of Public Works to execute the agreement with the California Department of Transportation if the City is successful in obtaining $743,400 of Bicycle Transportation Account (BTA) funds and authorizes $82,600 of Transportation Development Act (TDA) Article III funds to match the state funds being requested to construct the SMART multi use bike path between College Avenue and Jennings Avenue.
10.3RESOLUTION - ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 4906 CHARMIAN DRIVE
This resolution, recommended by the Department of Community Development, confirms the special assessment lien in the amount of $13,183.75 against the property located at 4906 Charmian Drive for violations of the City Code that remain uncorrected by the responsible party, Bank of America Home Loans, and authorizes recording of a lien and placing the assessment on the property tax roll for collection.
10.4RESOLUTION - RESCINDING FEBRUARY 15, 2011 APPROVAL OF ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 4010 FINLEY AVENUE AND RE-ASSESSING LIEN This resolution, recommended by the Department of Community Development, rescinds the Council approval of the special assessment lien on February 15, 2011 for 4010 Finley Avenue and approves the special assessment lien in the amount of $56,748.11 against the property located at 4010 Finley Avenue for violations of the City Code that remain uncorrected by the responsible party, Bilingual Broadcasting Foundation, Inc., and authorizes recording of a lien and placing the assessment on the property tax roll for collection.
10.5RESOLUTION - AMENDMENT TO THE CITY CLASSIFICATION AND SALARY PLAN TO RECLASSIFY TWO VACANT SENIOR ADMINISTRATIVE ASSISTANT POSITIONS TO ADMINISTRATIVE TECHNICIAN POSITIONS IN ENGINEERING SERVICES, PUBLIC WORKS DEPARTMENT (This item was continued from the March 1, 2011, Regular Council Meeting)
This resolution, recommended by the Human Resources Department, amends the City’s Classification and Salary Plan by reclassifying two (2) vacant Senior Administrative Assistant positions in Org. 100406 to Administrative Technician positions in Org. 100402 and Org. 100407. This action is expected to result in cost savings for CIP projects and will have no financial impact to the General Fund.
10.6RESOLUTION - ELNOKA VILLAGE ENVIRONMENTAL IMPACT REPORT CERTIFICATION APPEAL
This resolution, recommended by the Community Development Department, grants the appeal and directs staff and the consultant to address the Council’s comments and direction regarding impact conclusions and adequacy of specific topic areas, and to bring the EIR back to Council for further review and consideration.
11. REPORT ITEMS
11.1
12 REPORT -- CITY COUNCIL EMERGING ISSUES
BACKGROUND: The City Council has regularly established priorities for emerging Council issues related to planning and development. The last time the City Council reviewed the emerging issues was on October 19, 2010. At that time, the Council directed staff to continue working on the existing in-process priorities, until the top six in-process projects were finished.
With those projects complete, the Emerging Issues Sub-Committee met on March 8, 2011 to discuss the status of the existing priorities and to make recommendations regarding emerging issues.RECOMMENDATION: It is recommended by the Emerging Issues Sub-Committee that the Council, by motion, adopt five priorities which focus on economic development, implementation of zoning changes for the bicycle master plan and historic preservation.

13 REPORT - ADOPTION OF MITIGATED NEGATIVE DECLARATION FOR BAYER NEIGHBORHOOD PARK AND GARDENS PARK MASTER PLAN
BACKGROUND: Over a period of nine months, five steering committee meetings and seven public workshops were conducted to fully enable public participation in the park planning process. During the planning workshops, members of the public chose features that were best suited to the needs of their community and determined the placement within the park.
LSA Associates, Inc. prepared an Initial Study (IS) consistent with the California Environmental Quality Act guidelines resulting in a Mitigated Negative Declaration for the Bayer Neighborhood Park and Gardens project. The proposed project would result in potentially significant impacts in: Air Quality, Biological Resources, Cultural Resources, Geology/Soils, Greenhouse Gas Emissions, Hazards & Hazardous Materials, Hydrology/Water Quality, Noise, Public Services, Transportation/ Traffic and Utilities/Service Systems. The project impacts will be mitigated to a less-than-significant level through implementation of recommended mitigation measures or through compliance with existing Municipal Code requirements and/or City standards. Recommended measures are summarized in the Initial Study/Mitigated Negative Declaration. This resolution would approve the adoption of Attachment A - Draft Master Plan as the Park Master Plan for Bayer Neighborhood Park and Gardens and adopt the Initial Study/Mitigated Negative Declaration for Bayer Neighborhood Park and Gardens.RECOMMENDATION: It is recommended by the Recreation, Parks & Community Services Department that the Council, by resolution, adopt the Initial Study/Mitigated Negative Declaration for Bayer Neighborhood Park and Gardens and adopt the Attachment A - Draft Master Plan as the Park Master Plan for Bayer Neighborhood Park and Gardens.

14 PUBLIC HEARING - VILLAS REZONING
BACKGROUND: On February 10, 2011, the Planning Commission adopted a resolution (7-0) recommending rezoning of 13.8 acres of the Villas properties located at 1755 Sebastopol Road and 1700 Hampton Way, within the boundary of the Sebastopol Road Urban Vision Plan. The rezoning would change the zoning of the site from R-3-15 Multi-Family Residential to R-3-18 Multi-Family Residential, which is consistent with the site's Medium Density Residential (8.0 to 18.0 units per acre) General Plan land use designation.
RECOMMENDATION: It is recommended by the Department of Community Development that the Council introduce an ordinance rezoning 1755 Sebastopol Road and 1700 Hampton Way to R-3-18 Multi-Family Residential.
