3. STUDY SESSION
3.1
2 OVERVIEW OF FISCAL OBLIGATIONS OF THE GENERAL FUND
Over the past several years, the City has been challenged by the fiscal impacts of an unprecedented economic downturn. In response, the public, City Council, and City staff have been evaluating the way the City does business in order to best serve the public with reduced resources. At this Study Session, staff will give a brief financial overview with emphasis on the fiscal obligations of the City such as Measure O baseline funding and labor and pension costs. After reviewing these issues, staff will discuss potential strategies to restore fiscal stability.
Council may provide staff direction.

3 COUNCIL GOAL - CITY-OWNED DOWNTOWN DEVELOPMENT OPPORTUNITY SITES
The goals adopted by the Council for 2011-2016 include Goal No. 1 - Create a Strong, Sustainable Economic Base. The performance measures for this goal include the strategic objective to have one or more shovel-ready projects for the two most important City-owned opportunity sites in the downtown available for development within 24 months. Staff will provide information on City-owned properties in the downtown and seek direction regarding the properties to be developed, the type of development preferred, and any specific requirements to be incorporated into a developer solicitation process.

CONSENT ITEMS
This resolution, recommended by the Public Works Department, establishes radar enforceable speed limits on Dutton Avenue between Sebastopol Road and West Third Street, North Dutton Avenue between West Third Street and West College Avenue, Fourth Street between College Avenue and Bryden Lane, Fourth Street between Bryden Lane and Farmers Lane and Brush Creek Road between Highway 12 and Montecito Boulevard.
10.2RESOLUTION -- FOUNTAINGROVE LODGE - APPROPRIATION OF FUNDS FOR PEER REVIEW SERVICES
This resolution, recommended by the Public Works Director, authorizes the Director of Finance to appropriate funds in the amount of $40,000 to Account Number 100601-5320 for Professional Consulting Services to conduct Peer Review as required by the Planning Commission on the Fountaingrove Lodge project, the source of funds being developer payments.
10.3RESOLUTION -- CONTRACT EXTENSION - COMMUNITY MEDIA ACCESS CENTER, INC.
This resolution, recommended by the City Manager's Office, approves a Third Amendment with the Community Media Access Center, Inc. to extend the contract term by three months.
10.4 ORDINANCE ADOPTION -- COMMERCIAL VEHICLE PROHIBITION
This ordinance, introduced at the September 13, 2011, Regular Meeting, prohibits commercial vehicles from using Earle Street between South A Street and Santa Rosa Avenue.
11. REPORT ITEMS
11.1
17 REPORT - REQUEST FOR DIRECTION ON WHETHER ALTERNATES MAY SUBSTITUTE AT CHARTER REVIEW COMMITTEE MEETINGS IN PLACE OF COUNCIL APPOINTEES
BACKGROUND: On August 2, 2011, Council established by resolution a Charter Review Committee for review of the City’s Charter, commencing in September 2011. The Charter Review Committee is to be comprised of twenty-one citizens of Santa Rosa, with each Council Member to appoint three members of the Committee.
At Council meeting on September 13, 2011, a question arose as to whether alternates could substitute in place of Council-appointed Charter Review Committee appointees. Council requested that this issue be addressed at the next scheduled Council meeting since it was not on the agenda. The first meeting of the Charter Review Committee is scheduled for September 29, 2011.RECOMMENDATION: It is recommended by the City Attorney’s Office that Council, by motion, provide direction on whether alternates may substitute at Charter Review Committee meetings in place of Council appointees.

18 REPORT -- MEASURE O ANNUAL REPORT (This item is being continued to the October 11, 2011, Regular Meeting)
BACKGROUND: Ordinance 3680 added Chapter 3-26 to the Santa Rosa City Code establishing a special transactions and use tax. The special tax measure, known as Measure O, increased sales tax by a quarter cent to fund specific Police, Fire, and Gang Prevention/Intervention programs, as set forth in the Ordinance.
In accordance with the Ordinance, a Citizen Oversight Committee was established, with members appointed by the City Council, to ensure the proper use of the Measure O funds. Each year, an Annual Report is prepared by City staff, reviewed by the Citizen Oversight Committee and presented to the City Council reporting on expenditures and activities during the past fiscal year.
RECOMMENDATION: It is recommended by the Finance, Police, Fire, and Recreation, Parks and Community Services Departments, and the Measure O Citizen Oversight Committee, that the Council, by motion, formally accept the FY 2010/11 Measure O Annual Report.

19 REPORT -- ADOPTION OF MOU - UNIT 17 - PROFESSIONAL - ATTORNEYS REPRESENTED BY THE SANTA ROSA CITY ATTORNEYS’ ASSOCIATION
BACKGROUND: The City’s representatives and representatives from Unit 17 - Professional - Attorneys, represented by the Santa Rosa City Attorneys’ Association, have met and conferred concerning a successor Memorandum of Understanding.
During negotiations, the Attorneys recognized the continuing financial difficulty facing the City of Santa Rosa and agreed on a one-year contract with no salary increases for the term of the contract with additional concessions equivalent to a 3.29% salary reduction.RECOMMENDATION: It is recommended by the Human Resources Department that the Council, by resolution, adopt the Memorandum of Understanding for and on behalf of the City’s Unit 17 - Professional - Attorneys represented by the Santa Rosa City Attorneys’ Association. The adoption of this one-year agreement will be effective July 1, 2011 and will end on June 30, 2012.

20 PUBLIC HEARING -- RONNE DRIVE ADDITION - REZONING
BACKGROUND: The project proposes to rezone three parcels (1646, 1680, and 1687 Ronne Drive) from the RR-40, RR-20, and CN zoning districts to the R-1-6 zoning district to gain consistency with the General Plan designation of Low Density Residential.
RECOMMENDATION: It is recommended by the Department of Community Development and the Planning Commission that the City Council, by Ordinance, rezone three properties located at 1646, 1680, and 1687 Ronne Drive from the RR-40, RR-20, and CN zoning districts to the R-1-6 zoning district to gain consistency with their General Plan designations.

21 PUBLIC HEARING -- CITIZENS' OPTIONS FOR PUBLIC SAFETY (COPS)
BACKGROUND: As part of the proposed state budget package for the current fiscal year, the Citizens’ Options for Public Safety (COPS) Program was continued. Santa Rosa’s share from the state general fund for the 2011/2012 fiscal year is $163,794 including interest. The COPS Program provides funding for local agencies for the purpose of ensuring public safety. Santa Rosa has used these funds to supplement three dispatch positions, one police sergeant and police officers assigned to the Gang Crime Investigations Team.
The COPS Program is a permanent on-going program subject to state funding. The State Controller allocates funds to each county in the Fall of each year. The funds are allocated based on population. The funds must be used for front line municipal police services and must supplement, not supplant, existing funding. The City Council is required to hold a public hearing each year to consider recommendations for use of the funds. In addition, a Supplemental Law Enforcement Oversight Committee is required for each county consisting of one municipal police chief, the county sheriff, the district attorney, the county’s executive officer, and one city manager.
The COPS Program funds are related to the passing of the State budget and may be subject to reduction.
RECOMMENDATION: It is recommended by the Police Department, that Council, by resolution, approve the recommendations for use of the Citizens' Options for Public Safety (COPS) Funds to continue to supplement three dispatch positions, one police sergeant and police officers for the Gang Crime Investigations Team in the amount of $163,794.

22 PUBLIC HEARING -- NEGATIVE DECLARATION, GENERAL PLAN AMENDMENT AND ZONING AMENDMENT FOR BICENTENNIAL MARKETPLACE (Continued from the September 13, 2011, Regular Meeting)
BACKGROUND: Proposal to change the General Plan land use designations for the approximately 4.2 acre site from Office and Very Low Density Residential to Retail and Business Service, and a change in the zoning classifications from CO (Office Commercial) and RR-40 (Rural Residential) to General Commercial (CG). On July 14, 2011, the Planning Commission recommended (4-3) that the Council approve the Negative Declaration, Rezoning, and General Plan Amendment.
RECOMMENDATION: It is recommended by the Department of Community Development and the Planning Commission that the City Council adopt the Negative Declaration; amend the General Plan land use designations for the approximately 4.2 acre site from Office and Very Low Density Residential, to Retail and Business Service; and, introduce an ordinance changing the zoning classifications from CO (Office Commercial) and RR-40 (Rural Residential) to General Commercial (CG).
