7. STAFF BRIEFINGS

This time is reserved for City staff to brief the Council on departmental issues of interest.  No action will be taken on these matters except to possibly place a particular item on a future agenda for Council consideration.

7.1 7  LUTHER BURBANK HOME & GARDENS ASSOCIATION STATUS REPORT

Last spring the Council approved Resolution No. 27627, “An Agreement between the City of Santa Rosa and Luther Burbank Home & Gardens Association” for the lease and administration of the Luther Burbank Home & Gardens and repealed the City Code establishing the Luther Burbank Home & Gardens Board. These actions have provided one governing body, the nonprofit Board of Directors, the authority to provide volunteer program administration and fund raising activities.  After their first quarter of managing LBH&G, members of the Board of Directors want to report their accomplishments and future goals for the organization. Staff will give a brief update of the site maintenance accomplishments, followed by a concise PowerPoint presentation illustrating the non-profit strategies for the next five years.

7.2 8  THIS PARK NEEDS YOU!

Due to budget cuts that reduced staff and money to pay for water, the Parks Division of the Recreation, Parks & Community Services Department can no longer keep your Neighborhood Park beautiful. We invite you to be part of the solution. Residents are encouraged to visit our website at www.srcity.org/volunteersantarosa for information on volunteering, donations and fundraising activities or call 543-3770.

7.3 9  UPDATE ON FIRE DEPARTMENT FIRECORPS

Staff will update Council on our citizen advocates’ accomplishments in direct delivery of public education in residential facilities, community wide events and during fire station tours and our Fire Chief for a Day program for 3rd grade students.  This has occurred through our FireCorps program within the Fire Prevention Bureau.  FireCorps is managed and implemented through a partnership between the National Volunteer Fire Council, the International Association of Fire Fighters, the International Association of Fire Chiefs and AmeriCorps which provides incentives for participation.

10.1 MOTION – APPROVING AMENDMENT 2 TO CITY ATTORNEY AGREEMENT AND INTRODUCTION OF ORDINANCE SETTING SALARY OF CITY ATTORNEY

This motion, recommended by the Human Resources Department, approves Amendment No. 2 to the Employment Agreement of the City Attorney and introduces an Ordinance Establishing the Salary and Other Compensation and Benefits for the City Attorney.

10.2 RESOLUTION -- SUPPORTING PROPOSITION 22 - THE LOCAL TAXPAYER, PUBLIC SAFETY AND TRANSPORTATION PROTECTION ACT OF 2010

This resolution, recommended by the Transit Department, requests that the City Council adopt the resolution in support of Proposition 22: The Local Taxpayer, Public Safety and Transportation Protection Act of 2010.

11. REPORT ITEMS

11.1 13  REPORT -- ORDINANCE INTRODUCTION – MODEL CODE ADOPTION - AMENDMENTS TO BUILDING AND SAFETY CODES

BACKGROUND:  The State of California has adopted and published new Model Codes. Such model codes go into effect in every City and County in the State of California 180 days after publication. The effective date for the Cities and Counties is January 1, 2011 for the California Building Code, California Historical Building Code, California Existing Building Code, California Plumbing Code, California Electrical Code, California Mechanical Code, and the California Green Building Standards Code.  The Health and Safety Code allows local jurisdictions to change or modify the State adopted model codes based on local geologic, climatic, or topographic conditions.  The International Code Council has also published the 2009 International Property Maintenance Code that is proposed to be adopted by reference into the Santa Rosa City Code.

The proposed local amendments have been recommended for adoption by the Santa Rosa Board of Regulation Appeals.

RECOMMENDATION:  It is recommended by the Department of Community Development that the Council introduce and have the first reading of the title of the code to be adopted and identify secondary codes, waive the reading of the text, and schedule a public hearing for the October 19, 2010 Council meeting.

The Health and Safety Code allows local jurisdictions to change or modify the State adopted model codes based on local geologic, climatic, or topographic conditions.

11.3 15  REPORT -- SPRING LAKE VILLAGE EXPANSION AND ANNEXATION PROJECT FINAL ENVIRONMENTAL IMPACT REPORT

BACKGROUND:  The Spring Lake Village Expansion and Annexation Project Final EIR, which is comprised of the Draft EIR and Mitigation Monitoring program, as well as the comments, responses to comments and replacement pages, evaluates the proposed expansion and related annexation for the Spring Lake Village senior community care facility, and the annexation of three adjacent parcels along Brey Road which are not part of Spring Lake Village.  The Draft EIR examined the potential environmental effects of the project in a number of impact areas and concluded that the project would have a significant effect on the environment if the Project were built as proposed without mitigation.  However, mitigation measures have been incorporated into the Project, reducing most of the significant impacts to a less-than-significant level. 

On August 12, 2010, the Planning Commission adopted a resolution (4-3) recommending the City Council certify the Final EIR.  The City Council is the final decision making authority for Certification of the Spring Lake Village Expansion and Annexation Project Final EIR.  To certify the Final EIR, the Council must find that the Final EIR adequately identifies and analyzes the environmental effects of the project and the alternatives, and was completed in compliance with the requirements of CEQA and the Santa Rosa City Code.

RECOMMENDATION:  The Planning Commission and Community Development Department recommend that the Council, by resolution, certify the Spring Lake Village Expansion and Annexation Final Environmental Impact Report.

11.4 16  REPORT -- AMENDMENT OF COUNCIL POLICY REGARDING APPOINTMENT OF BOARDS AND COMMISSIONS (Continued from the September 28, 2010 Regular Meeting)

BACKGROUND:  Council Policy 000-06 sets forth the Council policy relating to appointments to Boards and Commissions.  It was last revised in May 2005.  The Council reviewed a proposed revision in February 2010 and requested additional clarifications and changes to the policy.

RECOMMENDATION:  It is recommended by the City Attorney's Office that the Council adopt the revised Council Policy 000-06, Appointments to Boards/Commissions.

11.5 17  PUBLIC HEARING – ORDINANCE ENACTING LOBBYIST REGISTRATION REQUIREMENTS AND RESOLUTION ADOPTING REGISTRATION FEE (Continued from the September 28, 2010 Regular Meeting)

BACKGROUND:  The Council initially considered a proposed Lobbyist Ordinance on March 9, 2010.  After receiving comments from the public and the Council, a council subcommittee met and made additional revisions to the ordinance to address the concerns that were raised.  The proposed ordinance requires persons receiving compensation expressly for the purpose of influencing administrative or legislative matters pending before the City to register on an annual basis with the City Clerk, and to file reports each time the lobbyist has been engaged by or terminated by a client.  It provides for a filing fee to offset the cost of administration of the ordinance, and prohibits Councilmembers, members of Boards and Commissions, and City staff from lobbying any City official, elected or appointed, for a period of one year following their employment or term of office with the City of Santa Rosa.  The Council will consider adoption of a resolution setting an annual registration fee of $94 and a $30 fee to file an amendment.  The proposed fees reflect full cost recovery.

RECOMMENDATION:  Adoption of an ordinance requiring registration and disclosures of lobbyist activities and the adoption of a resolution setting registration fee is a matter of Council discretion.
