OVERVIEW OF FISCAL OBLIGATIONS OF THE GENERAL FUND, SECOND STUDY SESSION
Over the past several years, the City has been challenged by the fiscal impacts of an unprecedented economic downturn. In response, the public, City Council, and City staff have been evaluating the way the City does business in order to best serve the public with reduced resources. At this Study Session, staff will give a brief financial overview with emphasis on the fiscal obligations of the City such as Measure O baseline funding, labor and pension costs, Measure P, and the creation of a long term financial plan. After reviewing these issues, staff will discuss potential strategies to restore fiscal stability. This is a continuation of the Study Session begun on September 27, 2011. The Council may discuss this item, ask questions of staff and provide direction.

CONSENT ITEMS
10.1MOTION -- CONTRACT EXTENSION - UNIFORM & LINEN RENTAL SERVICES
This motion, recommended by the Finance Department, awards Amendment No. 6 to Contract 008892 for a one-year contract extension for uniform and linen rental services, to Aramark Uniform Services, Novato, CA, with no increase to contract unit prices, in the amount of $106,186.34. Funding for this expenditure has been allocated in various Key Numbers in the FY 2011-12 operational budget.
10.2RESOLUTION -- APPLICATION TO THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM FOR GRANT FUNDS FOR THE LOWER COLGAN CREEK RESTORATION PROJECT AND ACCEPTANCE AND APPROPRIATION OF FUNDS
This resolution, recommended by the Utilities and Transportation and Public Works Departments, authorizes the application to the Environmental Enhancement and Mitigation Program requesting $350,000 for the Lower Colgan Creek Restoration Project. It is further recommended that if grant funding is awarded, and upon approval of the grant contract, the Council directs the Chief Financial Officer to increase JL Key P54007 titled "Lower Colgan Creek Restoration" by the amount of the grant.
10.3 RESOLUTION - DENYING APPEAL AND GRANTING MONTECITO MARKETPLACE CONDITIONAL USE PERMIT
The Council heard an appeal on this matter at the October 4, 2011, Regular Meeting. Council made a motion to deny the appeal subject to revisions to the CUP and directed staff to bring back a revised CUP at the meeting of October 11, 2011. This resolution and the attached CUP reflect the modifications made to eliminate the 24 hour operation.
10.4 ORDINANCE ADOPTION -- CITYWIDE ZONING CODE TEXT AMENDMENT TO CHANGE THE ZONING CODE (SECTIONS 20-36 AND 20-70) REQUIREMENTS FOR BICYCLE PARKING
This ordinance, introduced at the October 4, 2011, Regular Meeting, amends Zoning Code Sections 20-36 and 20-70 consistent with the Bicycle and Pedestrian Master Plan.
11. REPORT ITEMS
11.1 REPORT -- MEASURE O ANNUAL REPORT
(This item is being continued to the October 18, 2011, Regular Meeting)
BACKGROUND: Ordinance 3680 added Chapter 3-26 to the Santa Rosa City Code establishing a special transactions and use tax. The special tax measure, known as Measure O, increased sales tax by a quarter cent to fund specific Police, Fire, and Gang Prevention/Intervention programs, as set forth in the Ordinance.
In accordance with the Ordinance, a Citizen Oversight Committee was established, with members appointed by the City Council, to ensure the proper use of the Measure O funds. Each year, an Annual Report is prepared by City staff, reviewed by the Citizen Oversight Committee and presented to the City Council reporting on expenditures and activities during the past fiscal year.
RECOMMENDATION: It is recommended by the Finance, Police, Fire, and Recreation, Parks and Community Services Departments, and the Measure O Citizen Oversight Committee, that the Council, by motion, formally accept the FY 2010/11 Measure O Annual Report.

REPORT -- ORDINANCE AMENDING, ADDING AND REPEALING CERTAIN PROVISIONS OF TITLE 14 - POTABLE AND RECYCLED WATER AND TITLE 15 - SEWERS OF THE SANTA ROSA CITY CODE
BACKGROUND: The City Code sets forth various provisions which relate to the City’s Utility Billing operations. Over the years, certain Code sections have not been revised to be consistent with changes to Board of Public Utilities and Council policies, rate Ordinances and rate Resolutions, and Utility Billing practices. Accordingly, a "clean-up" of Chapter 14-04 (Potable Water and Recycled Water Service), Chapter 14-08 (Potable Water Rates) and Chapter 15-20 (Sewer Charges) of the Santa Rosa City Code is needed to bring the Chapters up-to-date.
RECOMMENDATION: It is recommended by the Finance and Utilities Departments, and the Board of Public Utilities, that the Council, by ordinance, amend, add and repeal certain provisions of Title 14 - Potable and Recycled Water and Title 15 - Sewers.

REPORT - REQUEST FOR FUNDING - SANTA ROSA CHAMBER OF COMMERCE "BUILDING ECONOMIC SUCCESS TOGETHER (BEST)" PROGRAM
BACKGROUND: The Santa Rosa Chamber of Commerce (Chamber) has requested $60,000 annually for five years for a total commitment of $300,000 to support their countywide economic development initiative entitled Building Economic Success Together (BEST).
RECOMMENDATION: The Department of Economic Development and Housing recommends that the Council adopt the resolution of support for the Santa Rosa Chamber of Commerce Building Economic Success Together (BEST) initiative, and consider the request for financial support to BEST during the Fiscal Year 2012/2013 budget development process.

PUBLIC HEARING -- SPRING LAKE VILLAGE EXPANSION AND PREZONING APPEAL
Spring Lake Village EIRs
BACKGROUND: On September 8, 2011, the Planning Commission held a public hearing to consider the proposed Alternative 1 (Refined) project. The Department of Community Development recommended that the Planning Commission recommend the City Council approve the project with conditions. The Commission voted 3-3-1, with one member abstaining. The split vote resulted in an effective denial. On September 13, 2011, an appeal of the Planning Commission’s action was filed by the applicant’s representative, Michelle Gervais.
RECOMMENDATION: It is recommended by the Department of Community Development that the City Council grant the appeal of the Planning Commission’s denial and:
1. Adopt the Addendum to the Spring Lake Village EIR, the California Environmental Quality Act findings, Mitigation Measures, Mitigation Monitoring Program, and Statement of Overriding Considerations; and,
2. Introduce an ordinance to prezone one parcel associated with the Spring Lake Village expansion from County RR-20 to PD 0308 (Spring Lake Village); and, prezone five parcels along Brey Road from the County RR-20 zoning district to the City RR-20 zoning district; and,
3. Introduce an ordinance to amend the PD 0308 (Spring Lake Village) zoning classification to allow changes to the existing Policy Statement and Development Plan and to change approximately 4.3 acres from RR-40 (Rural Residential) to PD 0308 (Spring Lake Village) zoning district; and,
4. Adopt a resolution to approve a Conditional Use Permit to construct 62 new senior units and allow for renovations to the existing Spring Lake Village campus.
