REPORT -- FY 2009/10 MEASURE O ANNUAL REPORT
BACKGROUND: Ordinance 3680 added Chapter 3-26 to the Santa Rosa City Code establishing a special transactions and use tax. The special tax measure, known as Measure O, increased sales tax by a quarter cent to fund specific Police, Fire, and Gang Prevention/Intervention programs, as set forth in the Ordinance.
In accordance with the Ordinance, a Citizen Oversight Committee was established, with members appointed by the City Council, to ensure the proper use of the Measure O funds. Each year, an Annual Report is prepared by City staff, reviewed by the Citizen Oversight Committee and presented to the City Council reporting on expenditures and activities during the past fiscal year. In addition, a brief review of first quarter expenditures under the finding of Fiscal Crisis for FY 2010/11 will be presented.
RECOMMENDATION: It is recommended by the Finance, Police, Fire, and Recreation, Parks and Community Services Departments, and the Measure O Citizen Oversight Committee, that the Council, by motion, formally accept the FY 2009/10 Measure O Annual Report.

REPORT -- ACCEPTANCE OF ADDITIONAL SALARY CONCESSIONS PRESENTED BY THE SANTA ROSA FIREFIGHTERS, LOCAL 1401, ON BEHALF OF EMPLOYEES IN THE CITY’S UNIT 2 – FIREFIGHTING
BACKGROUND: The City’s representatives and representatives from Unit #2 – Firefighting, represented by the Santa Rosa Firefighters Local 1401, have met and conferred concerning additional salary concessions in Fiscal Year 2010/2011. Acceptance of these concessions will result in approximate salary savings of $689K to the General Fund and provide 24.6% of the funding needed to close the $2.5M budget shortfall.
RECOMMENDATION: It is recommended by the Human Resources Department that the Council, by resolution, accept the salary concessions presented by the Santa Rosa Firefighters, Local 1401 on behalf of employees in Unit 2 – Firefighting for the period of July 1, 2010 through June 30, 2011 and authorize the Mayor to sign an amendment to the MOU to implement these changes.

PUBLIC HEARING – RETAIL CENTER DESIGN GUIDELINES
BACKGROUND: The issue of “Big Box Guidelines” was initiated by the Council in November 2007 as a Council Emerging Issue. The current proposal reflects an evolution of direction since the original work plan was adopted by the Council in May, 2008, and subsequently adjusted through a series of public meetings and hearings with the Council, Design Review Board and Planning Commission. The current proposal is an update of the City’s retail center design guidelines, specifically addressing larger retailers and the redevelopment of existing centers. On July 15, 2010, the Design Review Board held a public hearing on the Amendments to Section 3.3 (Retail Centers and Commercial Districts) of the Santa Rosa Design Guidelines, and recommended (7-0) that the Council approve the Amendments subject to some minor revisions prior to final publication. On August 12, 2010, the Planning Commission held a public hearing on the item and recommended (7-0) that the Council approve the Amendments.
RECOMMENDATION: It is recommended by the Design Review Board, Planning Commission and Department of Community Development, that the Council, by resolution, approve the Amendments to Section 3.3 (Retail Centers and Commercial Districts) of the Santa Rosa Design Guidelines.

PUBLIC HEARING – LUTHER BURBANK HOME AND GARDENS CITY CODE TEXT AMENDMENTS
BACKGROUND: On May 11, 2010, the Council adopted (6-0-1) Ordinance No. 3942 which effectively dissolved the Luther Burbank Home and Gardens Board, and specifically repealed Chapter 2-05 and amended Sections 13-24.076, 17-22.146 and 20-58.020 of the City Code. The Amendments replaced references of "Luther Burbank Home and Gardens Board" with "the Director of Recreation, Parks, and Community Services." As a result, the decision making authority changed from a City Board to staff for major landmark alteration permits on this site.
On July 7, 2010, the Cultural Heritage Board directed staff to prepare City Code text amendments to ensure that the development review process for the Luther Burbank Home and Gardens site is not any different than how projects are processed on similarly zoned Historic Combining (-H) District sites. On August 4, 2010, the Board held a public hearing and recommended (4-0-3) that the Council amend Title 17 and Title 20 of the City Code to effectively change the decision making authority for major landmark alteration permits on this site to the Cultural Heritage Board.

RECOMMENDATION: It is recommended by the Cultural Heritage Board and Department of Community Development, that the Council introduce an ordinance and approve the City Code text amendments regarding processing procedures for projects proposed on the Luther Burbank Home and Gardens site.
PUBLIC HEARING -- ADDING CHAPTER 6-50, STREET PERFORMERS, OF THE SANTA ROSA CITY CODE AND ADOPTING PERMIT REPLACEMENT FEE
BACKGROUND: This chapter of the City Code would allow street performers to perform in public areas in accordance with the ordinance. The existence of street performers in the City provides a public amenity that enhances the character of the City. This chapter encourages such performances to the extent that they do not interfere with the reasonable expectations of residents to the enjoyment of peace and quiet in their homes or to the ability of businesses to conduct their businesses uninterrupted. This chapter seeks to balance the interests of the performers with those of the residents and businesses of the City. The ordinance provides that a permit replacement fee of $5.00 shall be charged to cover the cost of reissuing lost permits. This fee may be amended by resolution.
RECOMMENDATION: It is recommended by the Art in Public Places Committee, the Recreation, Parks & Community Services Department, Economic Development & Housing Department, and the Police Department that the Council introduce an ordinance permitting street performers in public areas and adopt a Permit Replacement Fee of $5.00.
