3. STUDY SESSION -- NONE

3.1 2  FALL FINANCIAL UPDATE AND REVISED FIVE-YEAR FORECAST

The purpose of the study session is to update the Council on the status of General Fund results for the first quarter of Fiscal Year 2010/11.  A Fall Financial Update will be presented, which compiles three months of actual FY 2010/11 data, along with a projection for the remainder of the year.  An economic outlook will be provided that discusses current and projected trends that will affect the remainder of this fiscal year and beyond.  An update of the General Fund’s Five-Year Forecast, including revised model assumptions, will also be provided.  New revenue, expenditure and reserve projections for fiscal years 2010/11 through 2014/15 will be discussed.

10. 9  CONSENT ITEMS

10.1 MOTION -- COMMUNITY ADVISORY BOARD COMMUNITY IMPROVEMENT GRANT RECOMMENDATIONS

This motion, recommended by the Community Advisory Board, adopts the Community Improvement Grant recommendations and authorizes staff to work with the organizations to complete the grants.

10.2 RESOLUTION -- GREENHOUSE GAS REDUCTION PROGRAM AGREEMENT FOR PROFESSIONAL SERVICES

This resolution, recommended by the Community Development Department, authorizes the mayor to sign a Professional Services Agreement with Pacific Municipal Consultants for preparation of a Greenhouse Gas Reduction Program including a Supplemental Environmental Impact Report (EIR) to the City's recently adopted General Plan EIR, a city/community Climate Action Plan (CAP) and integration of these documents into the General Plan through a General Plan Amendment package which is funded through the Energy Efficiency and Conservation Block Grant (EECBG) from the Department of Energy (DOE).

10.3 ORDINANCE ADOPTION -- LUTHER BURBANK HOME AND GARDENS CITY CODE TEXT AMENDMENTS

This ordinance, introduced at the October 12, 2010 Regular Meeting approves City Code text amendments regarding processing procedures for projects proposed on the Luther Burbank Home and Gardens site.

10.4 ORDINANCE ADOPTION – STREET PERFORMERS PERMIT REPLACEMENT FEE

This ordinance, introduced at the October 12, 2010 Regular Meeting adopts a permit replacement fee of $5.00.

11. REPORT ITEMS

11.1 10  REPORT -- SOLID WASTE ADVISORY GROUP

BACKGROUND:  The County of Sonoma will provide an update on the activities of the Solid Waste Advisory Group and discuss the priorities and objectives developed by the group for developing a long term solid waste option.
Council will discuss and provide direction regarding the priorities and objectives.

RECOMMENDATION:  It is recommended that the Council adopt a resolution supporting the priorities and objectives developed by the Solid Waste Advisory Group for exploring a long term solid waste option.

11.2 11  REPORT – PROGRESS REPORT AND UPDATE ON 2010/2011 WORK PLANS FOR COUNCIL GOALS AND STRATEGIES

BACKGROUND:  The Council set aside two days, March 6 and 7, 2009, to conduct a Goal Setting Session to review the progress on the current Council goals and begin work on developing a new set of goals for the next two years.  The seven goals that were prioritized by the Council: 
• Creating and Sustaining a Vital Downtown 
• Develop and Sustain a Regional Gang Prevention Effort 
• Develop a Sustainable Organization 
• Sustain Efforts to Make Santa Rosa a More Inclusive Community 
• Sustain Leadership in Environmental Initiatives 
• Focus on Seniors and Youth 
• Sustain Thriving Diverse Neighborhoods 
Council liaisons have worked with staff conveners, board and commission representatives, and members of the community to develop work plans for each of the goals.  The City Manager will present an overview of each goal’s work plan to the full Council so that any questions or proposed revisions to the work plans can be discussed.  Staff and community members have continued to work on the elements of the plan and report back to the Council on their progress on a quarterly basis.

RECOMMENDATION:  It is recommended that the Council receive the progress report on the work plans for the 2009-2011 Council Goals.

11.3 12  REPORT –COUNCIL EMERGING ISSUES

BACKGROUND:  The Council has established priorities for emerging Council issues; these priorities are organized as existing projects, and emerging issues priority A, B and C. On September 27, 2010, the Council’s Emerging Issues Subcommittee met to discuss the status of the existing priorities and to make recommendations regarding emerging issues priorities A, B and C. Since October 2009, one existing priority has been completed – The Downtown Station Area Specific Plan Consistency Amendments.

The Subcommittee concluded that staff resources should remain focused on completing the existing, in-process, priorities including the Greenhouse Gas Reduction Program-Climate Action Plan, the Green Building Program, the North Station Area Specific Plan and Density Bonus Ordinance, among others. 
RECOMMENDATION:  It is recommended by the Council’s Emerging Issues Subcommittee that the Council, by motion, affirm the existing property projects and approve the revised list of the priority B and C Projects.

11.4 13  PUBLIC HEARING -- MODEL CODE ADOPTION -- AMENDMENTS TO BUILDING AND SAFETY CODES AND REPEAL OF CITY CODE CHAPTERS 18-34 AND 21-09

BACKGROUND:  The State of California has adopted new construction related codes that go into effect on January 1, 2011.  These codes are the updates to the California Code of Regulations – Title 24.  City staff is proposing amendments to these codes to address local conditions to be consistent with regionally adopted fire sprinkler amendments and to increase the compliance level for “green building” compared to the minimum requirements in CALGreen (Title 24, Part 11).

Based on Council direction, and meetings with a focus group, staff has prepared alternatives that would additionally enhance the CALGreen requirements.  The proposed ordinance would need to be augmented with additional text if those enhancements are required.

RECOMMENDATION:  It is recommended by the Community Development Department that the Council, by ordinance, adopt by reference, with local amendments and administrative changes, the 2010 model codes as adopted by the State of California, and the 2009 International Property Maintenance Code.  These amendments include the following:
• Adoption of an enhanced green building program for both residential and nonresidential projects that include amendments for an enhanced program at the Voluntary Tier I level for all new structures in the City of Santa Rosa.  This provides an enhanced green building program in very close proximity to the Council directive and promotes uniformity in the region.
• Adoption of revisions to the City Code that update the Review and Abatement of Existing Building methodology for review and retrofit design standards.
• Adopt revisions to the California Building Code that require additional fire sprinkler requirements for new buildings plus additions and alterations of both residential and nonresidential buildings.
• Repeal existing Chapter 18-34, Local Energy Efficiency Standards, and Chapter 21-09, Green Building.

11.5 14  PUBLIC HEARING – MODEL CODE ADOPTION -- AMENDMENTS TO CALIFORNIA FIRE CODE

BACKGROUND:  The State of California has adopted and published the 2010 California Fire Code.  The model State codes will go into effect in all California Cities and Counties effective January 1, 2011.  The Health and Safety Code allows local jurisdictions to change or modify the State adopted model codes based on local geologic, climatic, or topographic conditions.  The Fire Department is requesting adoption of the 2010 California Fire Code with local amendments and administrative changes.

RECOMMENDATION:  It is recommended by the Fire Department that the Council, by ordinance, adopt by reference, with local amendments and administrative changes, the 2010 California Fire Code.
