CONSENT ITEMS
10.1 RESOLUTION -- ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 1850 WEST 3RD STREET
This resolution, recommended by the Department of Community Development, confirms the special assessment lien in the amount of $5,233.61 against the property located at 1850 West 3rd Street for violations of the City Code that remain uncorrected by the responsible parties, Paul and Annette Heidecker, and authorizes recording of a lien and placing the assessment on the property tax roll for collection.
This ordinance, recommended by the Board of Public Utilities, amends Chapter 14-04 (Potable Water and Recycled Water Service) of the Santa Rosa City Code to add provisions for recycled water rates for users served by interruptible supply.
10.3 RESOLUTION - UPHOLDING APPEAL OF PUBLIC CONVENIENCE OR NECESSITY (PCN) DETERMINATION FOR "OFF SALE" ALCOHOL LICENSES FOR A TYPE 20 (BEER AND WINE) FOR ARCO AM/PM MARKET AT 136 COLLEGE AVENUE
This resolution memorializes the Council's October 20, 2009 decision to uphold the appeal and overturn the decision of the Community Development Director's determination that the public convenience and necessity would not be served by the issuance of a new off-sale alcohol license for beer and wine sales at 136 College Avenue, Santa Rosa.

10 PUBLIC HEARING - REQUEST FROM PETALUMA ECUMENICAL PROPERTIES (PEP HOUSING) THAT THE CITY DECLARE ITS INTENTION TO ISSUE TAX-EXEMPT MULTIFAMILY HOUSING REVENUE BONDS IN AN AMOUNT NOT TO EXCEED $11,000,000 TO ASSIST THE FINANCING OF THE CONSTRUCTION AND DEVELOPMENT OF ACACIA LANE SENIOR APARTMENTS (4711 SONOMA HIGHWAY)
BACKGROUND: Petaluma Ecumenical Properties (PEP Housing) has requested that the City declare its intention to issue tax-exempt multifamily housing revenue bonds to assist the financing of the construction and development of Acacia Lane Senior Apartments, a 44-unit affordable rental housing development located at 4711 Sonoma Highway in northeast Santa Rosa (the Project). The U.S. Internal Revenue Code requires that the Council hold a Tax Equity Fiscal Responsibility Act (TEFRA) public hearing prior to considering approval of a resolution declaring the City's intention to issue bonds. Multifamily housing revenue bond financing is structured so that the City has no financial liability to the bondholders. The Project owner is responsible for payment of all costs of bond issuance.
RECOMMENDATION: It is recommended by the Department of Economic Development and Housing that the Council, following the public hearing, by resolution, declare the City's intention to issue tax-exempt multifamily housing revenue bonds to assist the financing of the construction and development of Acacia Lane Senior Apartments, an affordable rental housing development located at 4711 Sonoma Highway, and authorize City staff to apply to the California Debt Limit Allocation Committee (CDLAC) for a bond allocation in an amount not to exceed $11,000,000.

11 PUBLIC HEARING - DRAFT SANTA ROSA GENERAL PLAN 2035 (CONTINUED FROM SEPTEMBER 22, 2009)
BACKGROUND: On September 22, 2009, the City Council opened and closed the public hearing regarding the Draft Santa Rosa General Plan 2035. The item was continued to allow time for council discussion and direction.
RECOMMENDATION: It is recommended by the Office of Advance Planning and Public Policy that the Council, by resolutions, certify the Final Environmental Impact Report for the Draft Santa Rosa General Plan 2035 and adopt Santa Rosa General Plan 2035.

12 PUBLIC HEARING -- REZONING FOR GENERAL PLAN CONSISTENCY- 2363 HARDIES LANE AND 691 WEST THIRD STREET (CONTINUED FROM SEPTEMBER 22, 2009)
BACKGROUND: On September 22, 2009 the City Council held a public hearing for the rezoning of 2363 Hardies Lane and 691 West Third Street, closed the public hearing, and continued action to a future date. The rezonings are proposed to achieve general plan consistency, and they forward draft general plan policy H-C-4, which calls for rezoning of Medium and Medium High Density sites of two acres or more concurrent with adoption of the Housing Element to facilitate the development of higher density sites.
RECOMMENDATION: It is recommended by the Department of Advance Planning & Public Policy that the Council introduce ordinances for the rezoning of 3.25 acres at 2363 Hardies Lane, and 2.87 acres at 691 West Third Street to R-3-18 (Multi-Family Residential).
