3. STUDY SESSION

3.1 2  FY 2011/12 BUDGET PROCESS AND CALENDAR

The purpose of this study session is to review the City’s budget process and calendar.  Budget and Financial Planning staff will briefly review the current budget and forecast and provide a draft calendar showing the City’s plan for building the FY 2011/12 budget. 
These items are being presented for informational purposes and require no action on the Council's part.

10. 8  CONSENT ITEMS

10.1 RESOLUTION -- MEMORANDUM OF UNDERSTANDING IN SUPPORT OF THE RETROFIT BAY AREA PROGRAM

This resolution, recommended by the Utilities Department, authorizes the City Manager to sign the Memorandum of Understanding between the Sonoma County Regional Climate Protection Authority and the City of Santa Rosa in Support of the Retrofit Bay Area: Comprehensive Residential Building Retrofit Program. No general funds will be expended in this cooperative agreement.

10.2 ORDINANCE ADOPTION – VEHICLES AND TRAFFIC CODE REVISION

This ordinance, introduced at the November 9, 2010 Regular Meeting, amends Section 11-20.020 of the City Code to revise yellow zone restrictions.


11. REPORT ITEMS

11.1 9  REPORT -- ADOPTION OF MOUS FOR THE CITY’S UNIT 3 – MAINTENANCE AND UNIT 16 – UTILITIES SYSTEMS OPERATORS REPRESENTED BY OPERATING ENGINEERS LOCAL 3

BACKGROUND:  The City’s representatives and representatives from Operating Engineers Local 3, representing the City’s Unit 3 – Maintenance and Unit 16 – Utilities Systems Operators, have met and conferred concerning successor Memoranda of Understanding.  In recognition of the City’s financial difficulty the Units ratified a 4.6% salary reduction to be implemented through mandatory time off (furlough).  The units will receive some minor changes to the vision benefit package.  Implementation of this package will result in approximately $565K in savings to the City with $232K in savings to the General Fund.

RECOMMENDATION:  It is recommended by the City’s Negotiating Team that the Council, by resolutions, adopt the Memoranda of Understanding for and on behalf of the City’s Unit 3 – Maintenance and Unit 16 – Utilities Systems Operators represented by Operating Engineers Local 3.  The adoption of these one-year agreements will be effective July 1, 2010 and will end on June 30, 2011.

*11.2 10  REPORT - ACCEPTANCE OF SALARY CONCESSION PRESENTED BY THE SANTA ROSA MANAGEMENT ASSOCIATION, ON BEHALF OF EMPLOYEES IN THE CITY’S UNIT 18 – MISCELLANEOUS MID-MANAGEMENT

BACKGROUND:  On August 25, 2009, Council adopted a Memorandum of Understanding for Employees in the City’s Unit 18 – Miscellaneous Mid-Management, for the period of July 1, 2009 through June 30, 2011.  In recognition of the City’s financial difficulty at that time, the Santa Rosa Management Association entered into this contract with no scheduled salary increases for the term of the agreement.

In recognition of the City’s continuing financial difficulty and consistent with Council’s budget reduction goals, employees in Unit 18 have agreed to a salary concession in Fiscal Year 2010/2011 consisting of the following:

1) A 3.62% salary reduction to be implemented through 73 hours of unpaid mandatory time off (furlough).

2) A reduction of 40 hours in the vacation sell-back benefit.
The unit will receive a minor change in their benefit package which will sunset on June 30, 2011.

RECOMMENDATION:  It is recommended by the Human Resources Department that the Council, by resolution, accept the salary concession presented by the Santa Rosa Management Association on behalf of employees in Unit 18 – Miscellaneous Mid-Management for the period of July 1, 2010 through June 30, 2011 and authorize the Mayor to sign an amendment to the MOU to implement the changes.

11.3 11  REPORT -- REQUEST TO TERMINATE THE EXISTING MEMORANDUM OF OPTION TO PURCHASE BETWEEN THE HOUSING AUTHORITY OF THE CITY OF SANTA ROSA AND THE CITY OF SANTA ROSA FOR 983 SONOMA AVENUE (BROOKWOOD HOMELESS SHELTER

BACKGROUND:  On January 15, 2002 the City of Santa Rosa (City) and the Housing Authority of the City of Santa Rosa (Authority) entered into a Purchase Agreement and Lease Option (Agreement) for the property and improvements located at 983 Sonoma Avenue (Property).  The Agreement specified that the City would lease the Property from the Housing Authority for the operation of the Brookwood Homeless Shelter, which opened in April 2002.  As a result of the City’s fiscal constraints, the shelter was closed at the end of FY 2008/2009.  The City does not have the funds to purchase the property and the Housing Authority is moving forward in utilizing its property to the fullest while eliminating potential costs for the City.  The City needs to terminate the existing purchase agreement so the Authority may lease to a non-profit group serving the larger Santa Rosa community.  An Agreement to Terminate Purchase Agreement and Lease Option and Memorandum of Option to Purchase has been prepared for the City and Authority to approve and execute.  The Authority took action on this item at its September 2010 meeting and authorized the Executive Director to execute the Agreement to Terminate Purchase Agreement and Lease Option and Memorandum of Option to Purchase for 983 Sonoma Avenue.

RECOMMENDATION:  It is recommended by the City Manager’s Office that the Council, by resolution, terminate the existing Memorandum of Option to Purchase and authorize the Mayor to execute the Agreement to Terminate Purchase Agreement and Lease Option and Memorandum of Option to Purchase for 983 Sonoma Avenue.

11.4 12  PUBLIC HEARING – MITIGATED NEGATIVE DECLARATION – STREAMSIDE DRIVE CREEK PATH ALONG SANTA ROSA CREEK FROM STREAMSIDE DRIVE TO MISSION CIRCLE

BACKGROUND:  The proposed project will provide a continuous multi use pathway along Santa Rosa Creek by closing a gap between Streamside Drive and Mission Circle.  The Initial Study concluded that the project would not have a significant impact on the environment, and a Notice of Mitigated Negative Declaration was issued and posted on March 25, 2008 and again on April 24, 2010, after revisions were made to incorporate greenhouse gas analysis.

RECOMMENDATION:  It is recommended by the Public Works Department that the Council, by resolution, adopt the Mitigated Negative Declaration and Mitigation Monitoring Plan for the Streamside Drive Creek Path project to construct a bicycle and pedestrian pathway from Streamside Drive to Mission Circle, approve the Project, and authorize the Public Works Department to proceed with final design, right-of-way acquisition, and bidding of the Project.

11.5 13  PUBLIC HEARING -- DENSITY BONUS ORDINANCE

BACKGROUND:  The Density Bonus Ordinance allows residential development projects to exceed the density allowed by the city's general plan and zoning code and to receive a concession or incentive when a certain percentage of affordable or senior units are provided. The Planning Commission held a public hearing on September 9, 2010, continued to October 14, 2010, to consider a revised density bonus ordinance meeting the provisions of state law. The Commission voted 6-0 recommending approval to the Council.

RECOMMENDATION:  It is recommended by the Planning Commission that the Council introduce an ordinance repealing existing City Code Chapter 20-31 and adding a new City Code Chapter 20-31, Density Bonus and Other Developer Incentives.
