SPECIAL JOINT MEETING OF THE CITY COUNCIL AND REDEVELOPMENT AGENCY

 NOTICE IS HEREBY GIVEN that the Redevelopment Agency of the City of Santa Rosa will hold a Special Meeting on Monday, February 7, 2011, in the Council Chamber, City Hall, 100 Santa Rosa Avenue, Santa Rosa, California, at 1:30 p.m.  The purpose of this meeting is to hold a Special Redevelopment Agency Meeting and a Special Joint Meeting with the City Council.  The Agenda for the meeting is:

BACKGROUND:  Governor Brown’s Budget Summary, released January 20, 2011, includes a proposal to disestablish redevelopment agencies effective July 1, 2011.  Urgency legislation may be introduced shortly that may immediately prohibit redevelopment agencies from incurring any further debt or contractual obligations.   In light of the Governor’s proposal, the Agency’s legal counsel has recommended that the Redevelopment Agency approve a resolution affirming existing Cooperation Agreements between the City and the Redevelopment Agency as the debt instrument to fund redevelopment administrative costs specifically authorized and approved in the FY 2010-11 budget.

RECOMMENDATION:  It is recommended by the Department of Economic Development and Housing that the Redevelopment Agency approve, by resolution, affirming Cooperation Agreements between the City and Agency as the debt instrument to fund redevelopment administrative costs. 

5.  6      FY 2010-11 BUDGET REVISIONS RELATED TO MUNISERVICES TAX INCREMENT AUDIT

          BACKGROUND:  The City contracts with MuniServices, LLC to provide revenue audits, including the detection and documentation of errors in the assignment of secured and unsecured assessments and the allocation of property tax revenues by Sonoma County.  MuniServices completed an audit of the Redevelopment Tax Rate Areas for Gateways, Santa Rosa Center and Southwest Project Areas for FY 2006-07 through FY 2009-10 resulting in net tax increment revenue to the Agency.  The Agency’s FY 2010-11 budget did not anticipate the increased revenue or the cost associated with MuniServices’ finder’s fee.  A budget revision is required to appropriate funds to pay this unanticipated cost. 

         RECOMMENDATION:  The Department of Economic Development and Housing recommends that the Redevelopment Agency, by resolution, approve increased Fiscal Year 2010-11 budget appropriations and authorize payment of contingency fees to MuniServices, LLC, for increased tax increment realized from revenue audits, subject to Council approval.

4.1 12 OBLIGATION OF REDEVELOPMENT FUNDS 

BACKGROUND:   Governor Brown’s Budget Summary, released January 20, 2011, includes a proposal to disestablish redevelopment agencies effective July 1, 2011.  Urgency legislation may be introduced shortly that may immediately prohibit redevelopment agencies from incurring any further debt or contractual obligations.  There are a number of projects for which the Agency and Council have allocated redevelopment funds through the budget process but the obligations have not yet been memorialized with a funding agreement.  A contractual obligation is necessary to protect these funds for local redevelopment projects.

RECOMMENDATION:  It is recommended by the Department of Economic Development and Housing that the Council and Redevelopment Agency adopt respective Resolutions: 

(a) approving twelve (12) funding agreements (listed below) in the total amount of $4,721,136 and make benefit findings; and, (b) provide direction regarding obligation of available appropriations and reserves by redevelopment project area.
